EB-3 CATEGORY RETROGRESSES FOR JULY 2024
The U.S. Department of State (DOS) released the July 2024 visa bulletin, which confirmed retrogression in the Employment-Based Third (EB-3) preference category. Readers were informed of the possibility of retrogression in the June 2024 visa bulletin. DOS determines that it has become necessary to retrogress the worldwide EB-3 final action date (including Mexico and Philippines) effective in July.
Given the continued high demand in this category, it will likely be necessary to either further retrogress the final action date or make the category “Unavailable” in August. This situation will be continually monitored, and any necessary adjustments will be made accordingly.
Visa retrogression occurs when more people apply for a visa in a particular category or country than there are visas available for that month. Retrogression typically occurs toward the end of the fiscal year as visa issuance approaches the annual category, or per-country limitations.
To further explain, the final action date for an oversubscribed category is the priority date of the first applicant who could not be reached within the numerical limits. If it becomes necessary during the monthly allocation process to retrogress a final action date, supplemental requests for numbers will be honored only if the priority date falls within the new final action date announced in this bulletin. If at any time an annual limit were reached, it would be necessary to immediately make the preference category “unavailable”, and no further requests for numbers would be honored.
