Every year thousands of American employers apply for the H-1B nonimmigrant work visa for temporary foreign workers. This H-1B season is expected to be even more intense!
On January 3, 2017, the Congress introduced the “Protect and Grow American Jobs Act” which proposed amending the definition of H-1B nonimmigrants and raising the minimum wage requirement.
Should the bill be enacted, the minimum wage requirement for H-1B employees will increase up to $100,000 per annum, which will eliminate the vast majority of the petitions.
The bill reflects President Trump’s strategy on “protecting American workers” and “ensuring that beneficiaries of the program are the best and the brightest”.
As a reminder, in April 2016, U.S. Citizenship and Immigration Services received 236,000 H-1B applications for 85,000 available visas (known as H-1B cap).
