USCIS Has Proposed Fee Changes


On May 4th, Department of Homeland Security (DHS) has proposed to increase the filing fees for many employment-based petitions and applications. If implemented, the proposed fees will take affect in the next fiscal year, starting on October 1, 2016.

The proposed fee changes affect both immigrant and nonimmigrant worker petitions, which includes Form I-526, Immigrant Petition by Alien Entrepreneur and I-924, Application for Regional Center Designation under the EB-5 Immigrant Investor Program.

USCIS also proposed to provide an additional fee for all existing Regional Centers - Form I-924A.

If the proposed fee changes are implemented, we will see the following increases for EB-5 cases:

  • Form I-526, Immigrant Petition by Alien Entrepreneur - increase from $1,500 to $3,675;

  • Form I-924, Application for Regional Center Designation under the EB-5 Immigrant Investor Program - increase from $6,230 to $17,795;

  • NEW Annual Form I-924A, Additional fee for existing Regional Center - $3,035.
